Trade Machinery – Terms and Conditions of Sale
1. General
These Terms and Conditions apply to all sales and transactions conducted by Trade Machinery (“the Seller”). By purchasing or placing an order, the buyer (“the Buyer”) agrees to these Terms and Conditions in full.
2. Nature of Goods
All machinery and equipment offered by the Seller are used or trade machines unless otherwise stated.
The Seller does not manufacture or refurbish machinery.
Machines are sold “as seen” / “as is”, in their existing condition at the time of sale.
3. Inspection and Condition
- Buyers are strongly advised to inspect the machinery before purchase.
- Inspections can be arranged by appointment at the Seller’s premises or other agreed location.
- By completing a purchase, the Buyer acknowledges satisfaction with the condition and suitability of the goods for their intended use.
- No returns, exchanges, or refunds will be accepted after the sale is completed.
4. No Warranty or Guarantee
- No warranty, guarantee, or representation is given by the Seller—express or implied—regarding the condition, performance, quality, or fitness for any particular purpose of the goods.
- All implied warranties or conditions (including those under the Sale of Goods Act 1979 or any equivalent law) are expressly excluded to the fullest extent permitted by law.
5. Pricing and Payment
- All prices are quoted in good faith but may be subject to change before sale confirmation.
- Unless otherwise agreed in writing, full payment is required before collection or delivery.
- Goods remain the property of the Seller until full payment is received and cleared.
- Payments are non-refundable once the transaction is complete.
6. Delivery and Collection
- The Buyer is responsible for arranging and covering all costs related to transport, loading, and offloading unless otherwise agreed in writing.
- Risk in the goods passes to the Buyer immediately upon collection or delivery.
- The Seller accepts no liability for damage or loss once goods have left the Seller’s premises.
7. Limitation of Liability
- The Seller accepts no responsibility for any direct, indirect, or consequential loss or damage arising from the purchase, use, or inability to use the machinery.
- The Buyer agrees to indemnify and hold the Seller harmless against all claims, costs, damages, or liabilities arising out of the use or resale of the goods.
- The Buyer acknowledges that used machinery may require servicing, repair, or refurbishment prior to use.
8. Health & Safety
It is the Buyer’s sole responsibility to ensure that the machinery purchased is installed, maintained, and operated in compliance with all relevant health and safety laws and regulations.
9. Governing Law
All sales are governed by the laws of England and Wales. Any disputes arising shall be subject to the exclusive jurisdiction of the English courts.
